Венецианская Комиссия потребовала отменить декрет-закон №674, позволявший правительству назначать внешних доверителей в 89 муниципалитетах, поскольку он не имеет отношение к режиму чрезвычайного положения.
Ожидается, что о принятом недавно решении Комиссии, будет официально объявлено в понедельник. В докладе говорится, что новые правила «внесли структурные изменения и не ограничиваются периодом действия режима ЧП». Отмечается, что «наличие местных органов власти является основой демократического общества, а избрание их местным населением – основа гарантирования участия людей в политическом процессе».
По информации корреспондента газеты Cumhuriyet Дуйгу Гювенчи, Венецианская комиссия исполняет обязанности консультационного органа в Совете Европы и консультирует Совет, членом которого является Турция, по юридическим темам. Доклады, ранее подготовленные Комиссией, также послужили основой для проведения в Турции повторной проверки в области правоприменения национальных норм. Венецианская комиссия призвала власти Турции предпринять четыре шага для решения проблемы:
- Отменить решения, принятые в соответствии с декрет-законом №674, который не является обязательным для режима ЧП. В частности, отменить назначения новых лиц вместо руководителей муниципалитетов, их заместителей и членов местных советов.
- Обеспечить реализацию принятия чрезвычайных мер, законов и директив, влияющих на местную демократию, путем проведения надлежащих справедливых дебатов в парламенте.
- Обеспечить надлежащую юридическую проверку мер, принимаемых муниципалитетами, наделенные особыми полномочия в рамках борьбы с терроризмом.
- Обеспечить надлежащие правила и нормы для возвращения местных представителей власти, которые были уволены или отстранены от должности по обвинениям в терроризме, если в отношении них не было вынесено окончательного судебного наказания.
